These Terms & Conditions apply to services supplied under the Blendingmind® brand through www.blendingmind.com.
Residential retreats are governed by separate Retreat Terms & Conditions.
The legal provider of the service will be identified before booking and confirmed in your booking confirmation.
Depending on the service, this may be Blendingmind UK Limited, Bates Schiesser Partnership or David Schiesser, registered with Irish Revenue as a non-resident sole trader.
Central contact: blendingmindukltd@gmail.com
Services are provided for education, spiritual exploration, personal development and wellbeing.
They are not intended to replace medical, psychological, psychiatric, legal or financial advice. No specific outcome can be guaranteed.
No diagnosis, treatment or healing claims are made.
Customers should continue to follow the advice of appropriately qualified healthcare professionals.
For customers resident in Germany, the services do not constitute the practice of medicine under the Heilpraktikergesetz (HeilPrG).
A booking request or enquiry does not itself create a contract.
A contract is formed when we confirm the agreed service in writing, including the relevant appointment or service details and price, unless otherwise stated in the applicable service-specific terms or booking confirmation.
Payment is due in accordance with the booking confirmation or invoice.
We reserve the right to decline a booking where there is a reasonable operational, business or safety justification.
Prices are confirmed before the contract is concluded. Payment must be made in accordance with the booking confirmation or invoice unless otherwise agreed.
Failure to pay when due may result in cancellation or suspension of services after reasonable notice.
Prices and applicable taxes are presented in accordance with the Blendingmind® VAT & Pricing Information.
Where consumers have statutory cancellation or withdrawal rights, those rights remain unaffected.
Full details are provided in the Blendingmind® Consumer Cancellation & Withdrawal Information.
Where you request a service to begin during an applicable statutory cancellation or withdrawal period, additional consent or acknowledgement may be required in accordance with that information.
Outside statutory cancellation or withdrawal rights, cancellations and rescheduling are governed by the booking confirmation and any service-specific cancellation terms communicated before the contract is concluded.
Customers are responsible for ensuring suitable internet access, equipment and access to the relevant online platform.
We are not responsible for interruptions or inability to participate caused by the customer's internet connection, equipment or systems outside our reasonable control.
Customers agree to provide accurate information, participate respectfully, follow reasonable instructions and behave appropriately.
Participation may be terminated for abusive, threatening, discriminatory or seriously disruptive behaviour.
Teaching materials, downloads, graphics, recordings and other original content supplied through Blendingmind® remain protected by applicable intellectual property rights and remain the property of the relevant rights holder unless otherwise stated.
Unless expressly agreed otherwise, materials and recordings supplied to customers are licensed for private personal use only and may not be reproduced, distributed, published, adapted, resold or used for teaching, training, coaching or commercial purposes without prior written permission, except where permitted by law.
Customers and participants may not make audio, video or other recordings of sessions without prior permission.
Where a session is recorded by or on behalf of Blendingmind®, participants will be informed and consent will be obtained where required.
Where a recording is provided to a customer, it is licensed for private personal use only unless otherwise expressly agreed.
Recordings and personal data are handled in accordance with the Blendingmind® Privacy Policy.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to applicable law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses arising from circumstances outside our reasonable control.
Nothing in these Terms affects your statutory rights as a consumer.
Personal information is processed in accordance with applicable data protection law and the Blendingmind® Privacy Policy.
We are not liable for delay or failure to perform obligations caused by circumstances beyond our reasonable control, subject to applicable law.
Concerns and complaints are dealt with in accordance with the Blendingmind® Complaints Procedure.
These Terms may be updated from time to time. The version applicable to the contract will normally be the version made available when the contract was concluded, unless a change is required by law or expressly agreed.
These Terms are governed by the laws of England and Wales.
If you are a consumer resident elsewhere, this choice of law does not deprive you of any mandatory consumer protections that apply to you under applicable law.
Where separate Retreat Terms & Conditions apply, the governing-law provisions contained in those Terms take precedence.
By confirming a service after being provided with or given access to these Terms, you agree to the Terms applicable to that service.
Nothing in this provision limits any mandatory consumer rights.
